We also consider whether supplementary technical or organisational measures are appropriate.

You can contact us for more information about the safeguards relevant to your personal data.

0909How long we keep personal dataHow long we keep personal data

We keep personal data only for as long as reasonably necessary for the purpose for which it was collected, including to satisfy legal, accounting, insurance and reporting requirements and to establish, exercise or defend legal claims.

When setting a retention period, we consider the amount, nature and sensitivity of the data, the risk of harm from unauthorised use or disclosure, the purpose of processing, whether that purpose can be achieved in another way, and applicable legal requirements.

In general: enquiries that do not lead to a transaction are kept for no longer than reasonably necessary to follow up and maintain an appropriate record of the enquiry; records connected with a quotation, booking, purchase or completed project may be kept for up to six years after the end of the relevant relationship, and longer where a legal, tax, insurance, warranty or dispute-related reason requires it; marketing information is kept until you opt out or we determine that it is no longer accurate or useful. We may retain minimal suppression information to ensure we honour an opt-out; cookie choices are kept for the period stated through the relevant cookie-control mechanism; and technical and security logs are kept for a limited period appropriate to troubleshooting, security and fraud prevention, unless a longer period is required to investigate an incident.

We may retain anonymised information that can no longer identify you for statistical or business-analysis purposes.

Where the law permits a technology to be used for statistical or appearance purposes without consent, we will provide the required information and a simple way to object.

The Website's cookie-control mechanism, where displayed, provides current information about the non-essential technologies in use, their providers, purposes and duration, and allows you to accept, reject or change your choices. You can also restrict or delete cookies using your browser settings, although parts of the Website may not function correctly if strictly necessary storage is blocked.

We do not treat acceptance of these terms or continued browsing as consent to non-essential cookies.

The Website is operated by The WRPD Group Ltd, trading as Forge Automotive (Forge Automotive, we, us or our). The WRPD Group Ltd is a company registered in England and Wales under company number 09158011. Its registered office is at Unit 5 Overland Park, Gelderd Road, Gildersome, Leeds, West Yorkshire, LS27 7FE.

0202What these terms coverWhat these terms cover

These terms apply only to your access to and use of the Website.

They do not govern the supply, installation or sale of any vehicle, component, product or service by Forge Automotive. Any work we agree to undertake, or anything we agree to sell, will be subject to a separate written quotation, order form, contract or set of trading terms. If there is any conflict between these Website terms and a separate contract for goods or services, the separate contract will take priority in relation to those goods or services.

Nothing on the Website forms part of a contract with us unless it is expressly incorporated into a written agreement signed or otherwise accepted by us.

0303Information on the WebsiteInformation on the Website

The Website provides general information about Forge Automotive, our capabilities, example projects and the vehicles, parts, products and services that may be available from us.

Website content is provided for general information only. It is not technical, mechanical, legal, insurance, financial or other professional advice and should not be relied on as such.

We take reasonable care when preparing the Website, but we do not guarantee that its content is complete, current, accurate or free from errors. In particular:

photographs, video, renders, colour samples and other visual material may be illustrative and may not reproduce a finish, colour, texture, scale or specification exactly;

displayed vehicles and example builds may include bespoke, discontinued, third-party or customer-supplied components;

specifications, compatibility, lead times, availability and pricing may change;

results vary according to the vehicle, its condition, the selected components and the agreed scope of work; and

references to performance, durability, warranties or expected outcomes are subject to the relevant manufacturer terms and the final written agreement with us.

You should obtain a written quotation and confirm all important details with us before making a decision or incurring any cost.

0404Enquiries, quotations and bookingsEnquiries, quotations and bookings

Sending an enquiry, uploading information, requesting a quotation or discussing a project with us does not:

create a contract between you and us;

amount to our acceptance of any proposed work;

reserve a workshop slot, vehicle, component or product;

guarantee availability, compatibility, price or delivery date; or

require either party to proceed.

A contract will arise only when the applicable quotation, order, booking or other written agreement has been accepted in accordance with its terms and any required deposit or payment has been received.

Any quotation is subject to the assumptions, exclusions and validity period stated in it. We may need to inspect a vehicle before confirming the final scope or price.

0505Vehicle modifications and third-party requirementsVehicle modifications and third-party requirements

You are responsible for telling us about any matter that could affect proposed work, including the vehicle's ownership, finance or lease status, existing damage, previous repairs or modifications, insurance requirements and manufacturer warranty conditions.

Vehicle modifications can affect insurance, warranties, finance or lease agreements, road legality, emissions, vehicle approval status and future resale. Information on the Website is not confirmation that a particular modification is suitable or lawful for your vehicle or intended use. You should obtain any necessary insurer, finance provider, manufacturer or regulatory approval before proceeding.

The contractual allocation of responsibility for a particular project will be set out in the relevant quotation or agreement.

0606Acceptable useAcceptable use

use it in any way that breaches applicable law or regulation;

attempt to gain unauthorised access to the Website, its hosting environment, source code, data or connected systems;

use the Website to transmit unlawful, defamatory, infringing, abusive or fraudulent material; or

We may restrict or suspend access to the Website if we reasonably believe these terms have been breached or the Website or its users are at risk.

If you submit text, photographs, vehicle details, registration information, documents or other material through the Website, you confirm that:

the information is accurate to the best of your knowledge;

you are entitled to provide it to us;

our use of it for the purpose of responding to your enquiry will not infringe another person's rights; and

it does not contain unlawful or malicious content.

You retain ownership of material you submit. You give us a non-exclusive, royalty-free permission to access, copy and use that material only as reasonably necessary to assess and respond to your enquiry, prepare a quotation, provide requested services, maintain our records and protect our legal rights.

We will handle personal data contained in submitted material in accordance with our Privacy Policy.

Do not submit confidential information that is not reasonably required for your enquiry. If photographs contain another person, personal documents or a visible registration number that is not relevant, you should remove or obscure that information where practicable.

The Website may contain links to third-party websites, social platforms, maps, finance providers, manufacturers or other services. These links are provided for convenience only.

We do not control third-party services and are not responsible for their availability, security, content, accuracy or privacy practices. A link does not amount to our endorsement. Your use of a third-party service is governed by that provider's own terms and policies.

1010Website availability and securityWebsite availability and security

We aim to keep the Website available and secure, but access may be interrupted and we do not guarantee that the Website will always be available, uninterrupted, compatible with your device or free from bugs, vulnerabilities or harmful code.

We may update, suspend, withdraw or change any part of the Website without notice. You are responsible for using appropriate security software and for configuring your device, browser and network safely.

1111Our responsibility to youOur responsibility to you

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights or remedies that cannot lawfully be excluded.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable, for business losses, or for losses caused by an event outside our reasonable control. These terms do not affect your statutory consumer rights.

If you use the Website for business purposes, then, to the fullest extent permitted by law:

the Website is provided on an "as available" basis and implied warranties and conditions relating to it are excluded;

we are not liable for loss of profit, revenue, business, opportunity, anticipated savings, goodwill, reputation, data, or for indirect or consequential loss arising from use of or inability to use the Website; and

we are not liable for reliance placed on general Website content instead of a written quotation or contract.

Nothing in this section limits liability arising under a separate contract for goods or services. That contract will contain the terms applicable to the relevant transaction.

1212Privacy and cookiesPrivacy and cookies

Our Privacy Policy explains how we collect and use personal data and how we use cookies and similar technologies in connection with the Website.

1313Changes to these termsChanges to these terms

We may update these terms from time to time, for example to reflect changes to the Website, our business or applicable law. The updated version will apply from the date shown at the top of this page. Changes to these Website terms will not retrospectively alter a separate contract already formed between you and us.

1414GeneralGeneral

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

If we delay enforcing these terms, that does not waive our right to enforce them later.

No person other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.

1515Governing law and courtsGoverning law and courts

These terms and any non-contractual dispute arising from them are governed by the law of England and Wales.
